Terms of Service

These Terms govern your access to and use of Opakhya. By creating an account or using the Service, you agree to these Terms. Please read them carefully, especially the sections on AI-generated output and limitation of liability.

1. Acceptance of these Terms

By accessing or using Opakhya (the “Service”), you agree to be bound by these Terms of Service and by our Privacy Policy. If you are using the Service on behalf of a firm or organisation, you confirm that you are authorised to bind that entity to these Terms.

2. The Service

Opakhya is an AI-assisted platform for discovering tax-litigation precedents, summarising orders, and drafting submissions. Features available to you depend on your plan. We may add, change, or remove features to improve the Service.

3. Accounts and eligibility

  • You must provide accurate account information and keep it up to date.
  • You are responsible for safeguarding your credentials and for all activity under your account.
  • The Service is intended for legal professionals and others authorised to handle case material.
  • You must be at least 18 years old to use the Service.

4. Free trial

New accounts include a 20-day free trial with no credit card required. The trial provides access to core features with usage limits (for example, document storage, monthly AI operations, and a single user). When the trial ends, you may choose a paid plan to continue using paid features; otherwise access to paid features is limited. We may modify trial terms for future sign-ups.

5. Plans, billing, and cancellation

  • Paid plans are billed in advance for the plan period you select (for example, monthly or yearly). Prices are shown on our pricing page and are inclusive or exclusive of taxes as indicated at checkout.
  • You may cancel at any time. Cancellation stops future renewals; your plan remains active until the end of the current paid period. Except where required by law, payments already made are non-refundable.
  • Enterprise arrangements are governed by a separate order form or agreement.

6. Acceptable use

You agree not to:

  • upload content you do not have the right to use, or that is unlawful or infringing;
  • attempt to breach, probe, or circumvent the security of the Service;
  • reverse engineer, scrape, or resell the Service except as permitted by law;
  • use the Service to build a competing product or to train a competing model;
  • upload malware or use the Service to harm others or violate any law.

7. Your content

You retain all ownership of the documents and content you upload (“Your Content”). You grant us a limited licence to host, process, and display Your Content solely to provide the Service to you and your invited workspace members. As described in our Privacy Policy, we do not use Your Content to train AI models.

8. AI-generated output is not legal advice

Opakhya uses artificial intelligence to surface precedents, summarise orders, and draft submissions. AI-generated output may contain errors, omissions, or outdated information and does not constitute legal advice. You are responsible for independently reviewing, verifying, and, where appropriate, having a qualified professional confirm any output before relying on it, filing it, or advising a client. You remain solely responsible for all professional judgements and filings.

9. Intellectual property

The Service, including its software, design, and trademarks, is owned by Opakhya and its licensors. These Terms do not grant you any right in our intellectual property except the limited right to use the Service in accordance with these Terms.

10. Confidentiality and security

We apply industry-standard safeguards to protect Your Content, including encryption in transit and at rest, role-based access controls, and audit logging. You are responsible for managing who you invite into a shared workspace.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others or to the Service. On termination, your right to use the Service ends and we handle your data as described in the Privacy Policy.

12. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate or complete.

13. Limitation of liability

To the maximum extent permitted by law, Opakhya will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid to us for the Service in the twelve months preceding the claim.

14. Governing law

These Terms are governed by the laws of India. Subject to applicable law, the courts of India will have jurisdiction over any dispute arising out of or relating to these Terms or the Service.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you within the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
